Welcome to Foundation for Human Kindness and Compassion ("the Foundation", "we", "us"). By accessing fhkc.org ("the Site") and/or making a donation or purchase, you accept these Terms and Conditions.

1. Purpose

To regulate access and use of the Site, as well as donation relationships, engagement, and, if applicable, sale of products (solidarity merchandising).

2. Eligibility

You must be of legal age in your jurisdiction. If acting on behalf of an entity, you declare that you have the authority to bind it.

3. Donations

• Donations are free and voluntary, non-refundable, and are allocated to the mission purposes described on the Site
• We will issue the corresponding receipt in the name of the donor, subject to the data provided

4. Purchases (if applicable)

• The purchase is completed upon payment confirmation. You will receive an email with the order summary
• Prices are in USD, include/exclude taxes as indicated
• We reserve the right to limit quantities and reject orders for operational or security reasons

5. Shipping, Times, and Risks

• See "Payment Methods and Shipping Costs". Risk of loss transfers to the carrier upon dispatch; upon receipt, it passes to the buyer
• International orders: the customer is responsible for taxes/customs at destination

6. Changes, Withdrawal, and Returns

• If the sale is remote, the right of withdrawal applies in accordance with Law 1480/2011 (Colombia): 5 business days from delivery, with return of the product in perfect condition and original packaging
• Withdrawal does not apply to personalized goods, personal/intimate use items, or products with opened security seals, as per law

7. Intellectual Property

Unless otherwise indicated, Site contents are the property of Foundation for Human Kindness and Compassion and/or third-party licensors. Reproduction without authorization is prohibited.

8. Acceptable Use

You will not use the Site for illegal activities, sending malware, circumventing security measures, mass data extraction, or infringing third-party rights.

9. Privacy and Personal Data

Data processing is governed by our Privacy Policy. By using the Site, you consent to such processing.

10. Limitation of Liability

To the extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages arising from the use of the Site or the inability to use it.

11. Modifications

We may update these Terms. We will post the date of last update. Continued use of the Site implies acceptance of changes.

12. Applicable Law and Jurisdiction

Governed by the laws of Colombia and the United States. Any dispute is subject to the judges of the applicable jurisdiction, unless otherwise legally determined.
